1. About Us and These Terms

This website, www.mightymindsmovement.org (the "Site"), is operated by Mighty Minds Movement NPC ("MMM", "we", "us"), a non-profit company incorporated in South Africa.

As required by section 43 of the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), we disclose the following:

By accessing or using the Site, you agree to these Terms and to our Privacy Policy, which forms part of these Terms. If you do not agree, please do not use the Site.

2. Changes to These Terms

We may amend these Terms from time to time. The current version, with its "Last updated" date, will always be published on the Site. Your continued use of the Site after an amendment constitutes acceptance of the amended Terms.

3. Use of the Site

You may use the Site only for lawful purposes. You may not:

• attempt to gain unauthorised access to the Site, its servers, or any connected systems;
• introduce malware, scrape the Site at scale, or interfere with its operation or security;
• use the Site to harvest personal information about any person, including our scholars;
• misrepresent your identity or affiliation, or impersonate MMM, its scholars, board members, or partners;
• use any content from the Site in a way that harms, exploits, or endangers any child featured on it.

Your use of the Site constitutes a valid data message and expression of intent for the purposes of section 11 of ECTA.

4. Users Under 18

The Site's informational content may be viewed by anyone. However, if you are under 18, you may not submit any form or send us your personal information through the Site without the consent of your parent or guardian, as explained in our Privacy Policy. Interest in the Pathways Series should ordinarily be routed through your school.

5. No Open Applications; No Offer

Our core scholarship operates strictly by invitation. Nothing on this Site is an offer of, application channel for, or entitlement to a scholarship, placement, mentorship, or participation in any MMM programme. Descriptions of the programme, alumni outcomes, and partner involvement are provided for information only, and individual results described on the Site are not a promise of similar outcomes.

6. Donations

1. Voluntary gifts. All donations are voluntary, unconditional gifts to MMM made in support of our objects as a non-profit company. Donations do not confer any right to a benefit, service, influence over scholar selection, or interest in MMM.
2. Use of funds. We apply donations to our programme and operations at our discretion, consistent with the purposes described on the Site, our governing documents, and applicable law. Figures on the Site (such as programme expense ratios and per-scholar costs) are good-faith estimates, not contractual commitments.
3. Processing. When you donate online, payments are handled by a third-party payment provider under its own terms, using a payment system that is sufficiently secure with reference to accepted technological standards (ECTA section 43(5)). Before you complete an online donation you will be given the opportunity to review the transaction, correct mistakes, and withdraw before final submission (ECTA section 43(2)). You can also arrange a donation by contacting us at inquiries@mightymindsmovement.org.
4. Refunds. Because donations are gifts, they are generally non-refundable. If you make a genuine error (for example a duplicated payment or an incorrect amount), contact us within 14 days and we will correct it where reasonably possible. Nothing in this clause limits any non-waivable right you have under South African law.
5. Tax. MMM is approved by the South African Revenue Service as a Public Benefit Organisation (PBO No. 930090981) and is authorised to issue receipts under section 18A of the Income Tax Act 58 of 1962 for qualifying donations by South African taxpayers, with effect from 6 July 2026. Donors give based on their own circumstances and should obtain their own tax advice; nothing on this Site constitutes tax advice. Cross-border donors are responsible for compliance with their local rules, and we will assist with appropriate routing structures where we are able.
6. Refusal. We may decline or return any donation at our discretion, including where acceptance would conflict with our values, the law, or our obligations.

7. Intellectual Property

All content on the Site (text, copy, the Mighty Minds Movement name and logo, photographs, design, and structure) is owned by or licensed to MMM and protected by South African and international intellectual property laws. You may view, download, and print content for personal, non-commercial purposes with attribution. Any other reproduction, distribution, or modification requires our prior written consent. Quotes and testimonials are used with permission of their authors and may not be reused without our consent and theirs.

Photographs and stories of scholars are published with consent (see our Privacy Policy) and may not be downloaded, republished, or used in any other context.

8. Third-Party Sites and Content

The Site links to third-party platforms (including our LinkedIn archive, our donation platform, and partner sites). We do not control and are not responsible for their content, terms, or privacy practices. Linking does not imply endorsement.

9. Accuracy of Information

We take care to keep the Site accurate and current, but content (including programme details, statistics, timelines, roster information, and funding figures) is provided for general information, may change without notice, and is provided "as is" without warranty of completeness or accuracy, to the extent permitted by law.

10. Disclaimer and Limitation of Liability

Please read this clause carefully: it limits our liability.

1. To the extent permitted by law, MMM, its directors, board members, advisers, mentors, scholars, volunteers, and partners will not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of, or inability to use, the Site or any linked third-party site.
2. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, although we use reputable infrastructure and security services.
3. Nothing in these Terms excludes or limits liability for fraud, or any liability that cannot lawfully be excluded or limited under the Consumer Protection Act 68 of 2008 ("CPA") or ECTA, including liability for gross negligence to the extent section 51 of the CPA applies. Where the CPA applies to you, these Terms must be read subject to it, and any provision found to be unfair or prohibited will not apply to you.

11. Indemnity

Please read this clause carefully: it requires you to indemnify MMM in certain circumstances.

To the extent permitted by law, you indemnify MMM against claims, losses, and expenses (including reasonable legal costs) arising from your breach of these Terms or your unlawful use of the Site. This clause does not apply to the extent the loss results from our own breach or negligence.

12. Privacy and Electronic Communications

Our Privacy Policy governs how we handle personal information collected via the Site. By using the Site's forms or emailing us, you consent to receiving administrative communications from us electronically. Marketing communications are sent only with your opt-in consent.

13. Disputes, Governing Law, and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. We would prefer to resolve any concern directly. Please contact inquiries@mightymindsmovement.org first and give us 30 days to respond before pursuing formal action. Subject to any right you may have to approach another forum (including under the CPA), the South African courts have jurisdiction over disputes arising from these Terms or the Site.

14. General

• If any provision of these Terms is invalid or unenforceable, the remainder remains in force.
• A failure by us to enforce a provision is not a waiver of it.
• These Terms, together with the Privacy Policy, are the whole agreement between you and MMM regarding use of the Site.
• You may not cede or assign your rights under these Terms; we may assign ours to a successor entity on notice via the Site.
